Your use of the Flight School Wingman Web Site, services and products are subject to these terms and conditions.
Definitions and Interpretation
In this Agreement the following terms shall have the following meanings:
“Content” means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site;
“Service” means collectively any online facilities, tools, services or information that Flight School Wingman makes available through the website either now or in the future;
“Product” means any electronic facility, tool, services or information that Flight School Wingman makes available through the website, or via other electronic means.
“System” means any online communications infrastructure that Flight School Wingman makes available through the Web Site either now or in the future. This includes, but is not limited to, web-based email, newsletters and email links;
“User” / “Users” means any third party that accesses the Web Site and is not employed by Flight School Wingman and acting in the course of their employment; and
“Website” means the website that you are currently using (https://flightschoolwingman.com) and any sub-domains of this site unless expressly excluded by their own terms and conditions.
1. Introduction
1.1 This document and any associated documents referred to within it, form the basis of the terms and conditions for the services provided by Flight School Wingman on the Flight School Wingman website.
1.2 When considering placing an order make sure that:
1.2.1 You read these terms and conditions carefully, paying particular attention to the section referring to refunds.
1.2.2 You read our privacy policy which gives information on how your personal data is used.
2. About Flight School Wingman
2.1 The Flight School Wingman website is operated and owned by Andrew Neofytou (Director).
3.Communication
3.1 You acknowledge and agree that electronic communication including email and by other electronic means including, but not limited to the Flight School Wingman website, shall be used as a means of communication over large distances. You also accept that communication by electronic means shall comply with any legal requirements as they would in writing.
3.2 Flight School Wingman will contact you by email or other electronic means as agreed between you the client and Flight School Wingman.
3.2 Flight School Wingman shall not be liable for any costs incurred by you should you wish to contact Flight School Wingman by other means.
4. Intellectual Property
4.1 All Content included on the Web Site, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Flight School Wingman, our affiliates or other relevant third parties. By continuing to use the Web Site you acknowledge that such material is protected by applicable United Kingdom and international intellectual property and other relevant laws.
4.2 Users may not reproduce, copy, distribute, store or in any other fashion reproduce material from the website unless given express written permission to do so by Flight School Wingman Ltd.
4.3 Users may not link to the Flight School Wingman website without first obtaining written permission.
4.4 Any agreement to link to the website must be:
4.4.1 Only linked to the Flight School Wingman home page.
4.4.2 Only linked to on a website that is owned wholly by you, and does not contain any copyrighted third party information or infringe the intellectual property of another company or individual . It must not contain and offensive or controversial content, or in any way infringe the laws of the UK or the laws of the country in which that website is hosted.
4.4.3 Used in such a way that it does not damage the reputation of Flight School Wingman or its associates.
4.4.4 Utilised in such a way that it not form any means of endorsement or approval on the part of Flight School Wingman where no endorsement or approval exists on my part.
5. Use of Purchased Content
5.1 All Content purchased by the User are made available under a personal use licence which means that the User is not permitted to share or make available any Content to people other than themselves.
5.2 Content supplied by Flight School Wingman may be used only by the User that purchased the service or product.
6. Product Delivery Policy
6.1 All services are provided subject to availability and acceptance. If Flight School Wingman is unable to provide a product or service, you have the right to cancel your order. You must provide valid email address so that Flight School Wingman can contact you if necessary.
6.2 Any order you place for content or a service, shall be considered as an offer to purchase our product or services. All such offers received from you are subject to acceptance by Flight School Wingman, and Flight School Wingman reserves the right to refuse any order placed by you at any time prior to acceptance, without providing an explanation.
6.3 Flight School Wingman will acknowledge receipt of any orders placed for a service. This does not constitute acceptance or your order by Flight School Wingman for any product or service.
6.4 A contract is only formed upon receipt of payment and delivery of the product or service to you, the client.
6.5 All Content purchased by the User is made available online by Flight School Wingman electronically and automatically once payment has been received through PayPal. No delivery of physical products is required to access the Content.
7. Links to Other Web Sites
This Web Site may contain links to other sites. Unless expressly stated, these sites are not under the control of Flight School Wingman or that of our affiliates now, or in the future. We assume no responsibility for the content of such web sites and disclaim liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another site on this Web Site does not imply any endorsement of the sites themselves or of those in control of them.
8. Privacy
Use of the Web Site is also governed by our Privacy Policy which is incorporated into these terms and conditions by this reference.
9. Disclaimers
9.1 Flight School Wingman makes no warranty or representation that the Web Site, and products or services contained therein will meet your requirements, that they will be of satisfactory quality, that they will be fit for a particular purpose, that they will not infringe the rights of third parties, that they will be compatible with all systems, that they will be secure and that all information provided will be accurate. Flight School Wingman makes no guarantee of any specific results from the use of the Service or Products.
9.2 No part of the Web Site, its content nor any of our services are intended to constitute advice and should not be relied upon when making any decisions or taking any action of any kind.
10. Availability of the Web Site
The Service is provided “as is” and on an “as available” basis. We give no warranty that the Service will be free of defects and / or faults. To the maximum extent permitted by the law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.
Flight School Wingman accepts no liability for any disruption or non-availability of the Web Site resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.
11. Limitation of Liability
11.1 To the maximum extent permitted by law, Flight School Wingman accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Web Site, products or services or any information contained therein. Users should be aware that they use the Web Site and its Content at their own risk.
11.2 Nothing in these terms and conditions excludes or restricts Flight School Wingman’s liability for death or personal injury resulting from any negligence or fraud on the part of Flight School Wingman.
11.3 Every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977. However, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.
12. Pricing
The prices of the Products and Services are quoted on the Website.
12.1 Prices quoted are for performance of the Services in the United Kingdom unless otherwise specified.
12.2 Prices quoted include VAT.
12.3 By giving notice to you at any time before delivery or performance of Flight School Wingman’s obligations to you, Flight School Wingman reserves the right to increase the price of the Products and Services to reflect any increase in the cost due to any factor beyond Flight School Wingman’s control (such as without limitation, any foreign exchange fluctuation, significant increase in the costs of labour, materials or other costs of manufacture). Should this occur, then you shall be entitled to cancel the order at any time before we have commenced providing the Products or Services.
13. Payment
13.1 Payment will be made electronically via our website using the “PayPal” link contained on the website. This protects you and Flight School Wingman Ltd.
13.2 Products or services will only be provided once payment has been received. Individual products and services will then be made available in electronic format (including .doc and PDF format).
13.3 Flight School Wingman will contact you electronically should any problem arise with your payment for the services requested.
13.4 Flight School Wingman will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from our Website.
14. Refunds
14.1 If you are not satisfied with the services provided, Flight School Wingman will refund fully the cost of your order, provided that your request is received not later than 14 days after date of purchase (see exemptions). Requests for refunds shall be made electronically to the Flight School Wingman contact email address. Customers shall state via email the reasons that they are requesting a refund of the product or service.
14.2 Refunds will be initiated by Flight School Wingman within five working days of receiving a customer refund request. Confirmation of the refund will be via email to the client.
14.2.2 Once initiated by Flight School Wingman please allow a further five working days for the banking network to process the refunded transaction.
14.3 Exemptions to the right to request a refund:
14.3.1 The Flight School Wingman guide to interviews and group exercises is non re-fundable.
14.3.2 The Flight School Wingman guide to passing a simulator assessment is non re-fundable.
14.3.3 If you choose a Skype, telephone or in person coaching service for interview and and group exercises, or simulator assessment, then you must notify Flight School Wingman at a point not exceeding 10 minutes from the start of the coaching session that you wish to terminate the session and request a refund. The session will be terminated at this time, and a refund actioned in accordance with 14.1.

16. Law and Jurisdiction
These terms and conditions and the relationship between you and Flight School Wingman shall be governed by and construed in accordance with the Law of England and Wales and Flight School Wingman and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
